Terms of Service
These Terms of Service ("Terms") govern your use of metroplexmedialab.com (the "Site") and any package you buy through it. The Site and our services are operated by Bernardo Langer, doing business as Metroplex Media Lab ("Metroplex Media Lab," "we," "us," or "our"). By using the Site or completing a purchase, you agree to these Terms. If you do not agree, please do not use the Site.
1. Use of the Site
You agree to use the Site lawfully and not to: misuse, disrupt, or attempt to gain unauthorized access to the Site or its underlying systems; introduce viruses or malicious code; scrape, harvest, or collect data from the Site without our permission; or use the Site in any manner that infringes the rights of others or violates any applicable law.
2. Packages, quotes and how an agreement is formed
The packages and prices on the Site describe what we sell. When you complete a purchase through our checkout, you and Metroplex Media Lab enter into an agreement on these Terms for the package described on the Site at the time of purchase. Submitting a form, requesting a free preview, or messaging us does not, by itself, create an agreement. Custom projects that we quote separately are governed by the written quote or agreement we send you, together with these Terms where that quote does not say otherwise.
3. Free homepage preview
The free preview is offered with no obligation to buy, one per business. We create it from your current public website. You may keep the preview image for your own reference, but the design remains ours and may not be used to build or publish a website unless you buy a package from us. We may decline a preview request, for example when we are at capacity or when the business or content is one we choose not to work with.
4. Scope, timelines and revisions
- Scope: each package includes what the Site lists for it at the time of purchase. Additional pages, features or services are quoted separately.
- Timelines: Refresh and Rebuild sites launch within 7 days, and Growth sites within 7 to 14 days depending on scope. Timelines start when we receive your completed onboarding form and the content we need. Waiting for your content, feedback, approvals or access to accounts (such as your domain, hosting or Google accounts) extends the timeline by the same amount.
- Revisions: each package includes two rounds of revisions after we deliver the full site for review. Further changes are quoted separately or covered by the Care plan.
- Languages: each package includes an English version plus one more language. We prepare the translation; we recommend that someone fluent on your side reviews it before launch.
- Your materials: you are responsible for the accuracy of the information you give us (such as prices, services, hours and claims about your business) and for having the rights to any logos, photos, text or other materials you provide.
5. Prices and payment
- Prices are in U.S. dollars. Applicable sales tax is calculated and added at checkout.
- Payments are processed by Stripe. We do not receive or store your full card number.
- Deposits: a 50% deposit starts work on your project. We invoice the remaining balance when your site is ready to launch, and the balance must be paid before we publish the site.
- Not included: third-party costs such as domain renewals, business email subscriptions (for example, Google Workspace), advertising spend, and paid software such as booking or CRM subscriptions, unless the package says otherwise.
6. Rebuild Monthly Plan
- The Rebuild Monthly Plan costs $199 per month, billed to your payment method on file starting on the day you purchase.
- Minimum term: the plan has an 18-month minimum term. During the term it includes the Care plan.
- Ending early: you may end the plan before the minimum term is complete by paying the difference between the Rebuild one-time price ($2,190) and the monthly payments you have already made. Care plan services end when the plan ends.
- After the minimum term: after 18 monthly payments, the plan continues as the Care plan at $79 per month unless you cancel.
- Missed payments: if a payment fails and is not resolved within 14 days, we may pause hosting and services until the account is brought up to date.
- Ownership: ownership of the website transfers to you, as described in section 9, once you have made 18 monthly payments or paid the early-ending amount above.
7. Care plan
The Care plan costs $79 per month and includes hosting, security updates, backups, up to one hour of edits each month, and support by text or email. Unused edit time does not carry over to the next month. Larger changes are quoted separately. You may cancel at any time; cancellation takes effect at the end of the current billing period. When you cancel, we provide your site files and help you move your domain to the provider you choose.
8. Cancellations and refunds
- If you cancel within 7 days of purchase and before we begin work on your project, we refund your payment in full.
- Once work has begun, payments are non-refundable. You still receive the revision rounds included in your package.
- Monthly plans are not refunded for partial months.
To cancel, email [email protected].
9. Ownership of your website
Once your package is paid in full, you own the design, text and images we create for your website, and the domain registered in your name. If you leave us at any time after that, we hand over your site files and help you move your domain. Until payment is complete, the work remains our property. Fonts, stock photos and third-party software used on your site remain subject to their own licenses. We may show completed work in our portfolio and marketing materials unless you ask us not to.
10. Intellectual property on this Site
All content on the Site — including text, graphics, logos, photographs, designs, layouts, page structure, source code, and the Metroplex Media Lab name, brand, and any portfolio work or case studies — is the property of Metroplex Media Lab or its licensors and is protected by U.S. and international intellectual-property laws. You may not copy, reproduce, distribute, modify, republish, frame, or create derivative works from any Site content or portfolio material without our prior written consent. Trademarks, logos, and brand names of third parties shown on the Site remain the property of their respective owners.
11. Third-party services
The Site and our services rely on third parties, including Stripe for payments, Google PageSpeed Insights for website checks, and messaging services such as WhatsApp. We do not control and are not responsible for the content, policies, or practices of any third party, and a link does not imply our endorsement.
12. Disclaimers
The Site is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free. We design and build websites to good professional standards, but we do not guarantee specific search rankings, traffic, leads or revenue.
13. Limitation of liability
To the fullest extent permitted by Texas law, Metroplex Media Lab and its owner shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, or data, arising out of or relating to the Site or our services, even if advised of the possibility of such damages. Our total liability for any claim relating to a purchase is limited to the amount you paid us for that package in the 12 months before the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless Metroplex Media Lab and its owner from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Site, the materials you provide to us, or your violation of these Terms.
15. Governing law and venue
These Terms are governed by and construed in accordance with the laws of the State of Texas, including the Texas Business and Commerce Code, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms, the Site or our services shall be brought exclusively in the state or federal courts located in Wichita County, Texas (Wichita Falls), and you consent to the personal jurisdiction and venue of those courts.
16. Changes to these Terms
We may revise these Terms at any time by posting an updated version on this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. Purchases are governed by the Terms in effect at the time of purchase.
